JinkoSolar has filed a lawsuit in Texas against Indian solar manufacturer Waaree Energies and its US subsidiary, Waaree Solar Americas, for allegedly infringing its n-type tunnel oxide passivated contact (TOPCon) patent (US11,824,136B2).

The patent, granted in 2023, covers solar cells, manufacturing methods, and photovoltaic modules. JinkoSolar has also secured patent protection in key markets such as China, Japan, Australia, and the European Union.

Waaree Energies, India’s largest solar PV module manufacturer, operates four production facilities in Gujarat with a total capacity of 12 GW. In December 2024, its US arm, Waaree Solar Americas, launched a 1.6 GW solar module manufacturing plant in Texas.

This lawsuit is part of JinkoSolar’s broader efforts to protect its intellectual property. In December 2024, it sued VSUN Solar, a subsidiary of Japan’s Fuji Solar, and has since taken legal action against Longi in China, Japan, and Australia.

As of now, Waaree Energies has not responded to the lawsuit.
